The government did not concede that there is immunity for core functions for “former” presidents, they conceded that there is immunity for core functions for the current president, but former presidents do not enjoy that immunity as the power of who gets such immunity during their term stays with the people. Otherwise how are the people to ever hold a rogue president accountable if the immunity remains after the office has been vacated by that person.
